Product warranty
Many people choose to buy the product that is on display, or in the showcase, as they usually have discounts. What many don't know is that, according to the Consumer Protection Code – CDC, these products have the same guarantee as products sold in the box.
The legal guarantee is dealt with in article 26 of the CDC, which provides a period for the consumer to complain about defects in products or services. The aforementioned article does not make any reservations or exceptions that remove the guarantee for products on display. To exercise the legal guarantee, the consumer simply needs to present the complaint together with proof of purchase, within 30 days, for non-durable services and products, or 90 days, for durable services and products.
The CDC also provides for the possibility of another type of guarantee, called contractual or extended, which is complementary to the legal guarantee. The extended warranty is described in article 50 of the same code and, although not mandatory, it must be delivered in writing, with all the necessary information for the consumer to use it. According to article 74 of the aforementioned legal diploma, failure to deliver the duly completed contractual guarantee term constitutes a crime and the penalty provided is 1 to 6 months of prision or fine.
Consumer Protection Code - Law No. 8,078, of September 11, 1990. Art. 26. The right to complain about apparent or easily detected defects expires on:
I - thirty days, in the case of provision of services and non-durable products;
II - ninety days, in the case of providing services and durable products.
§ 1° The statute of limitations begins counting from the actual delivery of the product or the end of the execution of the services.
§ 2° Obstacles to decay:
I - the complaint demonstrably formulated by the consumer before the supplier of products and services until the corresponding negative response, which must be transmitted unequivocally;
II - (Vetoed).
III - the initiation of a civil investigation, until its closure.
§ 3° In the case of a hidden defect, the statute of limitations begins at the moment the defect becomes evident.
Contractual Protection
Art. 50. The contractual guarantee is complementary to the legal one and will be granted through a written term.
Single paragraph. The warranty term or equivalent must be standardized and adequately clarify what the same warranty consists of, as well as the form, term and place in which it can be exercised and the burden borne by the consumer, and must be delivered to him , duly completed by the supplier, at the time of supply, accompanied by an instruction manual for installation and use of the product in didactic language, with illustrations. Criminal Offenses
Art. 74. Failing to provide the consumer with a properly completed warranty term with a clear specification of its contents;
Penalty: Detention of one to six months or a fine.
